The ANHA was notified by the Alabama Department of Public Health (ADPH) that it plans to notify health care facilities that applied for and received approvals for alternate care site designations during the COVID-19 pandemic of the status of their waivers in light of the Governor’s plans to rescind her declaration of a public health emergency (PHE) for Alabama.
Governor Ivey has announced her plans not to continue the state of emergency (SOE) past July 6, 2021. When ADPH first issued the waivers for Alternate Care Sites, it was stated that the waivers would terminate at the end of the PHE, but intentionally did not specify that further, since it was unknown how the PHE was going to play out a year ago; however, ADPH did stress that the waivers from ADPH rules for the alternate care sites were based on the CMS blanket waivers.
If you have applied and received an alternate care site waiver, we recommend you contact your legal counsel to discuss the expiration of the PHE.
